Many of the brands selling CBD online are owned by multi-level marketing companies, like Herbal Renewals, which sells CBD under the name RSO. These companies often sell products containing nothing more than hemp seed oil, which doesn’t have much CBD in it. In fact, the FDA recently sent warning letters to four companies claiming that their products are illegal.
So where does the CBD come from? Well, it turns out that most of the CBD sold online today isn’t really CBD at all. Instead, it’s usually extracted from industrial hemp plants — specifically hemp plants that are bred to produce seeds that are very low in CBD.
The problem is, that these plants aren’t always easy to tell apart from regular marijuana plants. If someone grows pot just for themselves, they might accidentally plant a hemp variety. Or, if they buy pre-made cannabis buds from stores, they could end up with a bag full of something completely different.
To make matters worse, studies show that CBD can look identical to THC under certain conditions, such as when it’s mixed together in a solution. Because of this, it’s hard to identify the difference between hemp and marijuana without testing.
This is where things start to get confusing. While CBD oil derived from hemp is legal, marijuana-derived CBD oils are not. Marijuana is classified as a Schedule I drug, meaning that it has “no accepted medical use and a high potential for abuse.” What this means is that marijuana-derived CBD oils fall outside of the guidelines set forth by the Drug Enforcement Agency.
